    Default "Pressure Equipment Regulation" to replace "Vessels Under Pressure Regulation"

    "The forthcoming Pressure Equipment Regulation (PER), soon to replace the VUP Regulation, does it have an impact on the gas industry?"

    Can anyone give their views on this topic?

    Still waiting for some Technocrat to provide brief answers. Watch this space.

    For those who don't know, the PER was gazetted on 15 Jul 09 and will replace the VUP regulations on 1 Oct 09.

    At the moment the PER is under review by industry members and in discussion with the Dept of Labour. Roadshow in major cities will be taking place. Will keep you posted if any changes

    The following Road Shows on the Pressure Equipment Regulations (PER) to take place during 2010:
    18 Feb 10 - Johannesburg
    23 Feb 10 - Cape Town
    24 Feb 10 - Port Elizabeth
    25 Feb 10 - Durban

    It has become imperative for all persons working in the gas industry to attend these workshops wherever possible. There is need to discuss the various interpretations that currently exists in the market as created by the PER.

    Be involved now, provide your input and bring to the table any aspect you might be experiencing in your workplace which vice versa impacts you and/or the PER.

    You will be informed of each venue and times as we approach the date.

    All gas practitioners need to comply to the Pressure Equipment Regulation (PER) especially to Regulation 17 for registration and licensing purposes.

    Under the requirements of the "Occupational Safety and Hazards Act - No. 85 of 1993" - Sections 43 and 44, and "Pressure Equipment Regulations, R 734, 15 Jul 09" as follows:

    Regulation 1: (Def) "Authorised Person" means...
    a person who is registered as competent within the scope of work for which an organisation [SAQCC Gas] approved by the chief inspector has registered that person

    Regulation 17: Gas reticulation equipment and systems

    (1) No person shall
    (a) handle, store or distribute any gas in any manner which includes the filling of a container, other than in accordance with the relevant health and safety standard incorporated into these Regulations under section 44 of the Act;

    (b) install or remove an appliance, pressure equipment or system for gas in any manner other than in accordance with the relevant safety standard incorporated into these Regulations under section 44 of the Act;

    c) install or remove a gas appliance, or a gas system or a gas reticulation system, unless such person is an authorised person; or

    (d) use pressure equipment or systems for gas in an manner other than in accordance with the relevant safety standard incorporated into these regulations under section 44 of the Act

    (2) After installation or re-installation, and before commissioning a gas system, the user shall ensure that an external inspection and a leak test are performed by an authorised person or an approved inspection authority as applicable in terms of sub-regulation (1 )(c).

    (3) An authorised person or an approved inspection authority shall issue a certificate of conformity after completion of a gas installation. modification. alteration or change of user or ownership in the form of Annexure 1.

    Be sure you comply - avoid legal penalties, fines and closing your business

    Default Pressure Equipment Regulation - Home Owners

    For those that are not aware of the impact of this regulation...

    As with the electrical Certificate of Compliance (COC) all owners need to ensure they are in possession of a valid COC for any form of gas installation. Very soon insurance house, Agents etc. will be on teh same playing field...a Seller will also be required by law to present a valid COC for the gas installation to the new Buyer.

    Be aware of this change in legislation

    Refer to Reg 17 (3) An authorised person or an approved inspection authority shall issue a certificate of conformity after completion of a gas installation. modification. alteration or change of user or ownership in the form of Annexure 1
